Lindsay Lohan is suing Pitbull for lyrics in his hit “Give Me Everything”, which includes the line: “Hustlers move aside, so I’m tip-toein, to keep flowin’/I got locked up like Lindsay Lohan.”

The lyric references Lohan’s July 2010 jail stint in which she served 13 days of a three-month sentence for a probation violation.

In the lawsuit, the “Mean Girls” star reportedly claims she is “a professional actor of good repute and standing in the Screen Actors Guild, is suing under the New York civil rights laws, which protects people from having their name exploited for commercial purposes.”

“The lyrics, by virtue of its wide appeal, condemnation, excoriation, disparaging or defamatory statements by the defendants about the plaintiff are destined to do irreparable harm to the plaintiff,” the lawsuit continues.

Lindsay Lohan is reportedly seeking an injunction to stop all the defendants which include Ne-Yo and Afrojack from broadcasting the song and seeks unspecified damages.

The song peaked at No. 1 on the Billboard Hot 100 chart in June and has sold 2.96 million copies since its release. Lindsay Lohan should pick up a couple million dollars in settlement money.

Lindsay Lohan risked being sent to jail on Tuesday after a Beverly Hills judge heard that the has been actress had missed more than nine alcohol education classes imposed for a 2007 drunk driving arrest.

Lohan, 24, dressed demurely in a black top and dark pants, listened as an official from her alcohol education program testified that the once promising movie star sent in excuses for missing her court-ordered classes that ranged from the death of her uncle to being stuck in North Carolina .

“I believe she had nine absences altogether” between December 2009 and July 2010, Cheryl Marshall co-owner of the Right On program testified at a court hearing into whether Lohan had violated her probation..

Tuesday’s hearing stemmed from a 2007 drunken driving and cocaine arrest. Lohan spent 84 minutes in jail that year as part of her sentence and was given three years probation.

Her career, at its height during the 2003 and 2004 movies “Freaky Friday” and “Mean Girls”, has since gone rapidly downhill. By age 20, Lohan was already attending Alcoholics Anonymous meetings and she went to rehab three times in 2007.

Last October, her probation was extended for a year after the actress used what prosecutors termed “very creative” excuses for missing several earlier classes.

Beverly Hills Superior Court judge Marsha Revel warned Lohan in October to take her probation seriously, and in December 2009 made clear that she must attend the alcohol education program on a weekly basis.

If Revel decides Lohan has violated that requirement, she could sentence the actress to jail on Tuesday, or impose new conditions on her freedom.

Revel has made clear she is losing patience with Lohan, briefly issuing two arrest warrants for her in May and June.

The first came when Lohan missed a probation review hearing after claiming to have lost her passport at the Cannes film festival, and the second after the actress’ alcohol monitoring anklet went off following the MTV Movie Awards.

Revel on Tuesday declined to address the issue of the alcohol monitoring device’s signal, which indicated Lohan had been drinking at a party following the Hollywood awards show.

The judge ruled that wearing the device was part of the bail conditions imposed on Lohan for missing the May court date, but was not a part of her 2007 probation.

Lohan protested via Twitter at the time that she had not been drinking.

Nicholas Frank Prugo

Nicholas Frank Prugo, a suspected  member of the ‘bling-ring,’ was arrested in conjunction with the Lohan & Patridge robberies.

He did not initially cooperate with authorities but on Oct. 6, Prugo, and his attorney, Sean Erenstoft, met with LAPD detectives to “return some stolen items and report information.”

Court records show that Prugo gave police a statement implicating several others in the thefts including Jonathan Ajar, Courtney Ames, Alexis Neiers, Diana Tamayo and a man Prugo can only identify as ‘Roy’. According to the court document, the crew removed cash, narcotics and thousands of dollars worth of jewelry.

Prugo & additional suspected ‘bling-ring’ member Rachel Lee were arrested after an unidentified tipster told Los Angeles Police Department detectives the pair were responsible for a robbery at Lohan’s Hollywood Hills in early 2009.

Prugo told detectives the doors to the celebrities’ homes were unlocked, with the exception Hilton & Lohan. The ring used TMZ.com and other websites determine travel itineraries & find the celebrities’ homes. He claims 19-year-old Rachel Lee led the ‘bling-ring.’

A search of Lee’s home in Las Vegas where she lives with her father turned up items from Hilton, Lohan and Patridge, including three personal photos of Hilton, two pairs of jeans and a white hat, according to a search warrant. A search of the Las Vegas home Lee shared with her father turned up a piece of paper with the names of her accomplices. Las Vegas Detective Ethan Grimes confirmed those people were the other subjects identified in the crime ring.

Police also found three computers, a Korean passport, 204 $100 bills and less than one ounce of marijuana when they arrested Lee at the home in northwest Las Vegas on Oct. 22, according to the warrants.

We hear LiLo could be called to speak with police as they investigate the disappearance of jewelery worth a nearly a half-million dollars, jewelry that she was wearing during an Elle photo shoot in London.

Elle magazine confirmed the rocks, loaned to Elle by fashion house Dior,  turned up missing a few days after their photo shoot with Lohan.

Elle also said they have “no reason to believe that Lindsay Lohan was in any way responsible.”
